Privacy Policy
Andesfundec S.A.S. (hereinafter "Andesfundec", "we") treats data protection as an institutional commitment, not a checkbox. This Policy explains in detail how we collect, use and protect the personal data received through andesfundec.com, in line with Ecuador's Organic Law on Personal Data Protection (Official Register 459, 2021) and EU practices voluntarily adopted.
1. Data controller
Controller: Andesfundec S.A.S., RUC 1793215476001. Registered office: Av. Amazonas N34-451 and Av. Atahualpa, Andes Plaza Building, 7th floor, Quito 170135 — Ecuador. Data Protection Officer: privacy@andesfundec.com.
2. Data we collect
We only collect three fields from the web form: name, email and the free-text message you decide to send. We never ask for ID, tax number or banking details at this stage. We keep minimal technical metadata (date, browser language) for six months for security purposes.
3. Purposes
Your data is used exclusively to reply to your enquiry, send you the requested information about the housing program and, only if you explicitly opt in later, send you quarterly updates. We never apply automated profiling with legal effects.
4. Legal basis
We process your data on the basis of your explicit consent when submitting the form and our legitimate interest in keeping the site secure. You may withdraw consent at any time by writing to privacy@andesfundec.com.
5. Retention
If your enquiry does not lead to a participation, we delete your data within 12 months at most. If you sign contractual documentation, we keep the data for the Ecuadorian commercial legal term (7 years) and then erase it.
6. Recipients
We do not sell or share data with third parties for commercial purposes. We share information only with: (i) technology providers contracted under confidentiality agreements (hosting in us-east-1, transactional email); (ii) Ecuadorian authorities upon formal request.
7. International transfers
Some technology providers operate in the United States. We apply standard contractual clauses, in-transit encryption (TLS 1.3) and at-rest encryption (AES-256).
8. Your rights
You have the right to access, rectify, erase, object to, restrict the processing of, and port your data. Exercise them by writing to privacy@andesfundec.com indicating the right invoked. We answer within 15 business days at most.
9. Security
We apply ISO 27001 organisational controls, quarterly access audits and mandatory privacy training for all staff. We do not use generative AI systems with identifiable personal data.
10. Changes
When this Policy changes substantially we publish the new version 30 days in advance and notify by email everyone who has given active consent.
